Phlex65 Privacy Policy

This Privacy Policy is a legal agreement between you Phlex65 Inc., a Delaware C Corporation, doing  business as Phlex65 (“Phlex65,” “we,” “us” or “our,” and also includes our licensors, licensees, suppliers,  advertisers, officers, members, employees, consultants, and agents) related to your use of the Phlex65  Services.

  

Our mission is to help match qualified Caregivers with Clients so that quality Caregiving Services can  occur. In this Privacy Policy, we tell you what information we receive from Clients and Caregivers, and  how we use it to help Clients match with Caregivers, and to improve our services.

In addition to this Privacy Policy, your use of Phlex65 Services is also subject to our Terms of Service,  which incorporates this Privacy Policy by reference. The Terms of Service can be viewed at  www.phlex65.com/terms

1.    Information We Collect


Information you provide to us

​

Registration information. When you sign up as an authorized User of a Phlex65 Services account, you  give us your name, email address, phone number and similar information.

Payment information. When you use a credit card with your Phlex65 Services account, a third party that  handles payments for us will receive your card information.  

​

Communications. If you contact us directly, we may receive additional information about you, such as  the contents of a message or attachments that you may send to us, and other information you choose  to provide.  

Caregiver application information. If you wish to apply to be listed as a Caregiver in the Phlex65 Services database, in addition to the basic User registration information we ask you, we will ask for name, email  address, phone number, employment and background verification (including references), work history,  DMV driving record, and a current TB clearance. We share this information with our partners who help  

us by running background checks on prospective Caregivers to help protect Clients and Users.

Caregiver payment information. Caregivers are paid directly by the Client through an independent third  party payment service. 


Information we collect when you use the Phlex65 Services

 

Location information. The Phlex65 Services is all about matching Clients and Caregivers. To do this, we  need to know where you are. When you open Phlex65 Services on your mobile device, we receive your  location. We may also collect the precise location of your device when the app is running in the  foreground or background. If you label certain locations, such as “home,” we receive that information.

Device information. The Phlex65 Services receives information from Users’ devices, including IP address,  web browser type, mobile operating system version, phone carrier and manufacturer, application  installations, device identifiers, mobile advertising identifiers, push notification tokens, and, if you  register with your social media account, your identifier for that account.

Usage information. To help us understand how you use the Phlex65 Services and to help us improve it,  we automatically receive information about your interactions with the Phlex65 Services, like the pages  or other content you view, your actions within the Phlex65 Services app, and the dates and times of  your visits.  

User feedback. As Users, Clients and Caregivers have the opportunity to provide feedback regarding  their experience with the Phlex65 Services and each Assignment, and provide ratings. This feedback is  posted as Content.

Information from cookies and similar technologies. We collect information through the use of “cookies” and similar technologies to understand how you navigate through the Phlex65 Services, to learn what  features or content is popular, and to save your preferences. Cookies are small text files that web  servers place on your device; they are designed to store basic information and to help websites and  apps recognize your browser. You can consult your web browser(s) to modify your cookie settings. If you  delete or choose not to accept cookies from us, you may be missing out on certain features of the  Phlex65 Services. 
 

Information we collect from third parties

Third party services. If you choose to register for the Phlex65 Services or otherwise link your Phlex65  Services account with a third party’s service (such as Facebook), we may receive the same type of  information we collect from you (described above) directly from those services.

Third party partners. We may receive additional information about you, such as demographic data,  payment information, or fraud detection information, from third party partners and combine it with  other information that we have about you.

Background information on Caregivers. Phlex65 Services works with third party partners to perform  background checks on prospective Caregivers, and we receive information from them such as publicly  available information about a Caregiver’s history.


2.     How we use the information we collect

We use the information we collect from all Users to:  

  • Help match Clients with Caregivers. 

  • Provide, improve, expand, and promote the Phlex65 Services. 

  • Analyze how Users use the Phlex65 Services. 

  • Communicate with you, including for marketing and promotional purposes. 

  • Personalize the Phlex65 Services experience for Users. 

  • Send you text messages and push notifications. 

  • Facilitate transactions and payments. 

  • Provide customer support. 

  • Respond to issues that may arise.  

  • Determine a prospective User’s eligibility to use the Phlex65 Services.  


3.     How we share the information we collect


Sharing between Clients and Caregivers

Clients and Caregivers that have been matched for Caregiving Services are able to see basic information  about each other, such as names and other similar information, and any information they have added to  their profiles. Clients and Caregivers who match their Phlex65 Services accounts to Facebook or other  social media accounts will also be able to see their mutual Facebook friends. Caregivers see the location  that the Client has provided. Clients see a Caregiver’s real-time location as the Caregiver approaches the  Client’s location.  


Sharing between Phlex65 Services and third parties

API and integration partners. If you match to the Phlex65 Services through an integration with a third  party service, we may share information about your use of the Phlex65 Services with that third party.  We may share your information with our third party partners in order to receive additional information  about you. We may also share your information with third party partners to create offers that may be of  interest to you.

Third party services. [Is it anticipated that the Phlex65 Services will allow a User to peruse other  websites, products, or services other than the Caregiving Services?] 

​

Service providers. We work with third party service providers to perform services on our behalf, and we  may share your information with such service providers to help us provide the Phlex65 Services.

Other sharing 

​

We may share your information with third parties in the following cases:  

  • With our actual or prospective investors, or related to a change of corporate control such as a  restructuring, merger or sale of our assets. 

  • With a government agency if it requests information and we think disclosure is required or  appropriate in order to comply with laws or a legal process. 

  • With law enforcement officials if we think doing so is necessary to protect the rights, property, or  safety of one or more Users, the Phlex65 Services, or the public. 

  • To comply with a legal requirement or process such as civil and criminal subpoenas, court orders or  other compulsory disclosures.  

  • To provide information about the use of the Phlex65 Services to existing or potential business partners  in aggregated or de-identified form that can’t reasonably be used to identify you. 

  • Whenever you consent in writing to the sharing.

4.     You can opt out of or change certain information


User profile information


While a Client’s name will always be shared with Caregivers, you can delete any additional information  that you added to your profile at any time if you don’t want Caregivers to see it. Clients will always be  able to see Caregivers’ names and other similar information.

Location information


While you can prevent your device from sharing location information at any time through your device’s  operating system settings, Client and Caregiver location is core to the Phlex65 Services and without it we  cannot provide our services to you.

Reviewing and editing your information 

​

You can review and edit certain account information by logging in to your account settings and profile. If  would like to terminate your Phlex65 Services account, please contact us through our Customer  Support. If you choose to terminate your account, we will deactivate it for you but may retain  information from your account for a certain period of time and disclose it in a manner consistent with  our practices under this Privacy Policy. We also may retain information from your account to collect any  fees owed, resolve disputes, troubleshoot problems, analyze usage of the Phlex65 Services, assist with  any investigations, prevent fraud, enforce our Terms of Service, or take other actions as required or  permitted by law.

Emails

​

You can always unsubscribe from our commercial or promotional emails but we will still send you  transactional and relational emails about your account use of the Phlex65 Services.

Text messages 

​

You can opt out of receiving promotional text messages by texting the word END to [Number] from the  mobile device receiving the messages. You may also opt out of receiving all texts from Phlex65 Services (including transactional or relational messages) by texting the word STOPALL to [Number] from the  mobile device receiving the message, however, opting out of receiving all texts may impact your use of  the Phlex65 Services. No mobile information will be shared with third parties/affiliates for  marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data  and consent; this information will not be shared with any third parties.

Push notifications 

​

You can opt out of receiving push notifications through your device settings. Please note that opting out  of receiving push notifications may impact your use of the Phlex65 Services.

 5.     Other

​

Data security 

​

We are committed to protecting the data of all Users. Even though we take reasonable precautions to  protect your data, no security measures is 100% secure all of the time, and we cannot guarantee the  security of your data.

Children’s privacy 

​

Phlex65 Services is not directed to children, and we do not knowingly collect personal information from  children under 13. If we find out that a child under 13 has given us personal information, we will take  steps to delete that information. If you believe that a child under the age of 13 has given us personal  information, please contact us at our Customer Support.

Modifications to our Privacy Policy 

​

We may in our sole discretion choose to modify this Privacy Policy from time to time. If we make any  material changes, we will let you know through the Phlex65 Services, by email, or other communication.  We encourage you to read this Privacy Policy from time to time to remain current about our privacy  practices. As long as you use the Phlex65 Services, you are agreeing to this Privacy Policy and any  updates we make to it.
